Two very different problems, one document family
People searching for a "birth affidavit" usually have one of two problems. Either a birth was never registered — common for people born at home decades ago, especially in villages — and now a certificate is demanded for a passport, pension or property matter. Or a date of birth is recorded, but recorded differently in two places: 5 June in the school register, 6 May on Aadhaar, and every application since has tripped over the difference.
Both problems involve affidavits; neither is solved by an affidavit alone. Understanding that distinction before you pay anyone is worth more than the document itself, so this page covers each situation separately — including what a sworn declaration genuinely achieves, and where the registrar, the education board or a court must act instead.

When a birth was never registered
Birth registration in India happens under the Registration of Births and Deaths Act, 1969, through the local registrar. When registration was missed, the law provides for delayed registration — a process that becomes more formal the longer the delay, with the oldest cases historically requiring an order from a designated authority before the registrar can act. The exact procedure and the authority empowered to approve old registrations have changed over the years, so we confirm the current requirement for your municipality or gram panchayat before preparing anything.
What stays constant is the evidence problem: the registrar needs credible material that the birth happened where and when claimed. Affidavits carry much of that weight. A typical late-registration file we help assemble includes:
- Affidavit of the person concerned (or a parent, for a minor) stating date, place and circumstances of birth and why registration was missed
- Corroborating affidavits from a parent or an elder relative with direct knowledge of the birth
- Whatever period documents exist — school records, vaccination card, horoscope, ration card entries
- The registrar's prescribed application form and fee

Date-of-birth declarations — what they can and cannot do
A DOB affidavit declares a person's date of birth on oath, usually to explain a discrepancy or to satisfy an office while a proper correction is underway. Legitimate uses include school admissions where no certificate has been obtained yet, scholarship or welfare paperwork that accepts declarations, and correction files where the receiving authority itself asks for an affidavit as one exhibit.
The honest limit: most authorities treat date of birth as a matter of official record, not personal declaration. Education boards, universities, employers, the passport office and UIDAI each have their own correction procedures — and where the claimed date conflicts with existing records, several will require a birth certificate or, in disputed cases, a court order. An affidavit supports those processes. It does not override them, and we will not pretend otherwise.
Two specific cautions from our casework. First, Aadhaar: UIDAI permits a date-of-birth update only once, under its current rules, and against its own list of acceptable proofs — spend that single correction wisely (see Aadhaar update rules, and the official uidai.gov.in for the live document list). Second, the gazette: people often assume a gazette notification can "change" a date of birth the way it publicises a name change. What a properly drafted birth affidavit contains
- Deponent and relationship. Who is swearing — the person concerned, a parent, an elder relative — and their connection to the person whose birth is declared.
- The person's full name, spelt as on existing records, with parents' names matching those records.
- Date and place of birth, stated exactly. Day, month, year in words and figures; village or hospital, taluka and district.
- The circumstances clause where relevant — home birth, records lost, registration missed — kept factual and brief.
- The purpose clause, naming the application the affidavit supports so it cannot drift into other uses.
- Verification and jurat. The deponent's verification, then the notary's attestation after in-person signing — which certifies the swearing, not the truth of the birth details themselves.
Stamp duty follows the general affidavit article of the Gujarat Stamp Act; after the 2025 amendment the working figure is ₹50, with ₹100 commonly used for safety, and we confirm the current value when arranging your e-stamp through the process described on our stamp paper and e-stamp page.

What we cannot do: issue a birth certificate, direct a registrar to register a birth, alter a board or university record, or guarantee that any authority accepts a declaration.
