Why stamp duty exists — and why offices care so much
Stamp duty is a tax that state governments levy on instruments — the written documents that create, transfer or record legal rights and obligations. Affidavits, agreements, bonds and powers of attorney are all instruments, and each attracts a duty set by the state's stamp law. The stamp paper or e-stamp certificate your document sits on is simply the proof that this tax was paid.
Why does a clerk at a counter care about a small revenue stamp? Because stamp law gives them reason to. An instrument that bears less duty than the schedule requires can face objections when an authority is asked to act on it, and short-paid instruments can attract penalties. In everyday terms: the office refuses your document, and you repeat the drafting-signing-notarising cycle on correct paper. The duty on an affidavit is small; the cost of getting it wrong is measured in weeks.
Stamping is also only the middle layer of a properly executed document — drafting comes before it, and for sworn documents notarisation comes after. This page covers the layer in between.
The Gujarat Stamp Act, 1958 — freshly amended in 2025
Stamp duty in Gujarat is governed by the Gujarat Stamp Act, 1958, whose Schedule I sets the duty for each class of instrument — affidavits under one article, agreements under others, bonds under their own. The controlling authority is the state's stamps and registration administration, whose official portal is stampsregistration.gujarat.gov.in.
The reason to be careful with any rate you read online: the Act was amended by the Gujarat Stamp (Amendment) Act, 2025, which received assent on 2 April 2025 and came into force from 10 April 2025, revising duty for a number of instrument classes. Rate lists published before that date can quote values that no longer apply. Where a current figure matters to your document, the honest procedure is the one we follow: check the schedule in force at the time of execution, against the official portal rather than a blog's summary.
What this means for you, practically
Do not buy stamp paper in advance "to save time" based on an old rate list, and treat leftover paper from previous years with caution. The few minutes it takes to confirm the current value is the cheapest insurance in this entire process.
Physical stamp paper vs e-stamp certificate
Gujarat pays stamp duty through more than one lawful channel, and the practical difference matters less than people fear — both prove the same tax was paid.
- Physical non-judicial stamp paper is the traditional format: pre-printed paper of a fixed denomination bought from licensed stamp vendors, onto which your document is printed or typed. Franking — a machine impression of paid duty on your document — serves the same role through authorised franking centres.
- E-stamp certificates are the modern format: a computer-generated certificate of paid duty attached to or printed with your document. In the e-stamping system, Stock Holding Corporation of India Ltd (SHCIL) acts as the central record-keeping agency, issuing certificates through its branches and authorised collection centres. Every e-stamp certificate carries a unique number that anyone can verify at shcilestamp.com — the feature that makes e-stamps far harder to counterfeit than paper.
Alongside the SHCIL system, Gujarat operates its own GARVI portal (garvi.gujarat.gov.in) for online stamp-duty payment and registration-related services. Which channel issues the stamp for a given document — particularly small-denomination affidavit stamps — varies with the document type and current administrative practice, so we confirm the appropriate authorised channel for your document at the time rather than promising one route here. What you receive either way is duty paid through an authorised channel, with the receipt in your file.
Which should you choose? Usually, whichever your receiving office is most comfortable with. Both are lawful; e-stamps win on verifiability, physical paper still circulates widely for small documents. This is a decision we make for you as part of preparation — you should never have to stand at a counter debating formats.
What everyday documents typically carry
For the documents our legal documentation desk handles most, the pattern looks like this — with the standing caveat that the 2025 amendment revised rates and the current schedule governs:
- Affidavits — a small denomination, typically in the ₹20–₹50 range depending on the applicable schedule; confirm the current value before executing. Some practitioners deliberately use a higher denomination such as ₹100 to pre-empt objections from conservative offices — a practice choice, not a legal requirement, and we tell you honestly whether your receiving office expects it.
- Agreements — duty varies by agreement type and sometimes by the value involved; rent and service agreements sit in different articles of the schedule than sale-related instruments.
- Indemnity bonds — bonds carry their own article and typically a higher duty than a plain affidavit; institutions demanding a bond often specify the stamp value they expect, which we follow when it meets or exceeds the schedule.
- Powers of attorney — duty depends on the kind of POA; property-linked POAs are a different world from a simple authority to collect documents, and some need registration beyond stamping.
Notice what is missing from this list: exact rupee figures stated as fact. That is deliberate. Schedules change — April 2025 proved it — and a website that hard-codes duty amounts is a website that will quietly mislead you a year later. The number that matters is the one confirmed against the current schedule on the day your document is executed, and that is the number we put in your written quote.
