Apostille versus attestation — the real difference

Both apostille and attestation do the same underlying job: they certify that an Indian document is genuine so a foreign authority can trust it. The difference is which country you are dealing with.

  • Apostille is a standardised certificate used between countries that are members of the Hague Apostille Convention, of which India is one. For those countries, an MEA apostille is the final step — no embassy stamp is needed after it.
  • Attestation (also called consular legalisation) is the route for countries that are not Hague members. Here the MEA attestation is usually followed by a further step at that country's embassy or consulate in India.

So the first thing to establish is simply this: is the destination country a Hague Convention member? That single fact decides whether you are on the apostille track or the attestation track. Confirm the current position and the exact requirement on the Ministry of External Affairs portal, mea.gov.in.

When you actually need this

You typically need apostille or attestation when a foreign authority asks for authenticated Indian documents. Common situations:

  • Study abroad — universities asking for authenticated degree, mark sheets and school certificates.
  • Employment abroad — employers or work-visa processes requiring authenticated education or experience documents.
  • Marriage or family — registering a marriage overseas, spouse visas, or family reunification needing authenticated birth and marriage certificates.
  • Residence and business — long-term residence, or setting up or trading through a business needing authenticated commercial documents.

Start from the receiving authority's instruction

The foreign university, embassy or employer defines exactly what it needs — which documents, apostille or attestation, and any recency requirement. Get that instruction in writing first, because it drives every step that follows. Do not begin authenticating documents on assumption.

Process

The usual sequence of steps

Authentication in India is generally a chain, not a single stamp. The exact chain depends on the document type and the issuing state, but it broadly runs:

  1. Notarisation, where required. Some documents — affidavits and certain copies — are notarised first. See notarisation explained.
  2. State-level authentication. The document is authenticated by the relevant state authority — for example the Home Department or a designated authority for personal documents, the education department for degrees, or a Chamber of Commerce for commercial documents.
  3. MEA apostille or attestation. The Ministry of External Affairs then apostilles (Hague countries) or attests (non-Hague countries) the document. Collection and delivery run through MEA-authorised outsourced service providers.
  4. Embassy legalisation, if attestation. For non-Hague countries, a final step at that country's embassy or consulate in India usually completes the chain.

Because several offices are involved, the realistic timeline runs from a few days to several weeks. Build in comfortable margin before any admission, visa or travel deadline. Confirm the current chain for your document and state on mea.gov.in, as procedures and authorised providers are updated from time to time.

An apostille certifies a document as it stands — it does not correct it. If your name or date of birth differs between the certificate being apostilled and your passport, the foreign authority can still reject it. It is far cheaper to reconcile a mismatch — sometimes through a gazette name changebefore you pay to authenticate a document that will then be questioned.

What is the difference between apostille and attestation?
Both authenticate a document for use abroad.
